Is a No-Court Divorce right for me?
A No-Court Divorce is right for you if you answer yes to the following questions:

1. You need a divorce only OR You need a divorce and orders on custody, child support, spousal support, and/or partition of community property.

2. If you need additional court orders, you and your spouse have come to or will come to agreements on all of the issues to be covered in the court orders. 

3. Your spouse will not file an objection to the divorce or set issues such as custody, child support, spousal support, and/or partition of community property for hearing.  

How much does an No-Court Divorce Cost?
The cost for a No-Court Article 103(1) Divorce is $2,500 and a No-Court Article 102 Divorce is $3,500. We also offer add-on packages if you and your spouse have agreed to incidental matters such as spousal support, child custody and or child support; and Community Property Partition.  See our pricing table below.
How long does a No-Court Divorce take to obtain?
No-Court Article 103(1) Divorce

In general, a No-Court Article 103(1) Divorce in Louisiana can be completed within two to three months. It is possible to complete your divorce within two weeks with our express divorce option (additional fees may apply). This duration depends on many factors. Some factors include your spouse’s willingness to sign a waiver of service and the time it takes the court to process your cases. Due to factors outside of its control, Rotharmel Shanks, LLC cannot guarantee any time in which the divorce will be completed.

No-Court Article 102 Divorce

In general, a No-Court Article 102 Divorce in Louisiana can be completed within two to three months after the separation period has been met.  It is possible to complete your divorce within two weeks after the separation period has passed with our express divorce option (additional fees may apply). This duration depends on many factors. Some factors include your spouse’s willingness to sign a waiver of service and the time it takes the court to process your cases. Due to factors outside of its control, Rotharmel Shanks, LLC cannot guarantee any time in which the divorce will be completed.

 

What if my spouse is not willing to agree to the terms of the Divorce?
Even if your spouse is unwilling to sign a waiver of service on your petition for divorce, Rotharmel Shanks, LLC can still obtain a judgment of divorce for you.  Our flat fee includes service through the sheriff/out-of-state service, if necessary.  It is not necessary for your spouse to sign the divorce paperwork if he/she is served by the sheriff/out-of-state service.  

However, if your spouse files an objection to your petition for divorce or files for any incidental demands, the No-Court Divorce will not be an option to you.  But Rotharmel Shanks, LLC can still help you with your legal matter even if a No-Court Divorce is not right for you.
